INVESTIGATION OF THE FRESHWATER FIVE'S CASE HAS REVEALED A CATALOGUE OF LAWBREAKING AND INCOMPETENCE BY THE VERY PEOPLE WHO SHOULD BE ENFORCING THE LAW

GUILTY….Undisclosed information that would have proved the men’s innocence hidden by the police and prosecution;
 
GUILTY….Critical police observations fabricated by police;
 
GUILTY….Critical police documents rewritten by police;
 
GUILTY… Police radios supposedly "break down", statements are untimed and notebooks "don't exist"  - to cover lack of corroboration 
 
GUILTY….Expert marine analysis given to the jury was crude and inaccurate;
 
GUILTY.…Key police witnesses were never interviewed or brought to court;
 
GUILTY….Jurors were fed information they weren’t entitled to know.

GUILTY... Independent Police Complaints Commission concludes the problem is lack of "training" rather than exposing the truth

GUILTY... Criminal Cases Review Commission fails to use its powers to demand documents from police but rather has a cosy chat with them               and turns the case down after sitting on it for 4 years

WHAT'S HAPPENING NOW?:

THE FRESHWATER FIVE ARE FIGHTING FOR A FAIR HEARING AT THE COURT OF APPEAL IN 2019


​An Appeal was lodged in July 2018, and supplemented in 2019.  Irrefutable marine radar data - kept hidden for NINE years - is now the basis of a new appeal which completely proves the men's innocence and undermines the prosecution case.
 
1...At trial, the prosecution claimed the Galwad crossed the Oriane's wake - and, within three minutes, the fishermen picked up bags of drugs thrown overboard by someone on the cargo ship.

The new evidence proves that was impossible - the two boats were simply too far apart.


2...The prosecution next claimed the fishermen dumped the bags of drugs at Freshwater Bay - just below Tennyson Downs. We are told they were being watched by two police officers on the cliff tops, who radioed over to report what they'd seen.

​The trial heard that no other police officers rushed to the scene to check this out- yet our new evidence proves a mystery vessel immediately raced to the same spot. Was this a police boat? If so, they would have seen there were no bags there - otherwise they would have seized them immediately. Or was it the real criminals, dumping the drugs that were eventually found the following morning?


3....At trial the prosecution insisted the bags could have drifted from the track of the Galwad to the spot where they were eventually found at Freshwater.

We can now prove the heavily-anchored holdalls could not have done this - for two reasons:

a...the seabed rises sharply at Tennyson and neither the bags nor the anchor could have dragged up such a steep slope;

b...the water was too shallow for the Galwad to get close enough.
