WHAT IS THE LATEST APPEAL ALL ABOUT ?
We have uncovered indisputable never-seen-before evidence that had been kept hidden for NINE YEARS.
The big breakthrough came in December, 2018. An independent marine expert had downloaded the spy boat's radar data for the police - copying the information on to floppy discs. These discs had remained carefully stored at his independent premises, out of reach of officers we believe engaged in perverting the course of justice in our case. The prosecution let us have access to these discs for the first time.
These disks contained radar data showing that:
- the tracks of the container ship and the fishing vessel did not cross
- that the spy boat - Vigilant was watching at the time that the fishing boat was supposed to have picked up the drugs mid channel but reported nothing,
- a RHIB entered Freshwater Bay heading directly to the site the drugs were found the next day soon after the fishing boat left the area - which is either a police vessel or a suspect vessel and either way is exculpatory evidence that should have been shared with the defence at trial
- an aircraft was above the cliffs when the police said no aircraft was available to film what the clifftop officers said they saw (the fishing boat offloading the drugs in Freshwater Bay)
WHY IS THIS SO IMPORTANT?
It proves either of the following:
*The area was definitely checked out by police immediately after the Galwad left. The plane flew low over Freshwater Bay, probably taking photographs, the RHIB - or whatever boat it was - sped straight there. Nothing was found. If it had, the police would have presented it as damning evidence in court.
OR
*It proves that another - mystery - vessel went to the location where the drugs were found, AFTER the Galwad had left. If that's the case, then that boat - and not the men - has to be suspect.
WHY IS THE EXISTANCE OF THIS EVIDENCE SO SHAMEFUL?
Because it proves the men are victims of NON-DISCLOSURE. The police always had this evidence in their possession. After all, it’s the radar data off their own spy boat. They just never mentioned it in court - and pretended it didn't exist.
HOW DOES THIS PROVE THE MEN’S INNOCENCE?
They were simply in the wrong place, at the wrong time - and this is why:
It shows that the police arrested and charged the wrong people. If that second boat is a police RHIB, the Freshwater Five could not possibly have been the ones to leave holdalls packed with cocaine in Freshwater Bay.
If they had, the police boat would have either photographed the bags there and then or dragged them out of the water immediately. Alternatively, they would have set a trap - and waited to see who came back to get them.
If the second boat wasn't the police, then whoever was on board that boat MUST have dropped the drugs.
